Examples could be cases needing an extension period of treatment resulting in pins and plates being inserted, instability of the ankle and severely limited ability to walk. The level of compensation within this bracket would depend on other factors such as sleep disturbance on a regular basis, scarring, impact of employment to name a few.
Moderate guidelines for ankle injuries range from £10,450 to £20,200. Examples could be fractures and ligament tears which could or do lead to difficulty walking on uneven ground, standing/walking for long periods and scarring to name a few.
Modest injury guidelines for ankle injuries can be up to £10,450. Examples are less serious, minor or displaced fractures, sprains and ligament injuries. The level in this bracket is determined by whether or not a complete recovery is made. If recovery is incomplete they will take into account details such as weakness in the ankle, scarring, aching, loss of movement and possibility of long term osteoarthritis.
Foot Injuries
The amount of compensation for foot injuries is split into 7 bands:
- Amputation of Both Feet
- Amputation of One Foot
- Very Severe
- Severe
- Serious
- Moderate
- Modest
Amputation of both feet would range between £128,750 to £153,200.
Amputation of one foot would range between £63,825 to £83,325.
Very Severe guidelines for foot injury compensation can be between £63,825 to £83,325. Examples are where the injury produces permanent or severe pain and permanent disability. This can include amputation of the forefoot where there was a big risk of full amputation needed or loss of a substantial section of a heel causing restricted mobility.
Severe guidelines for this foot compensation can be between £31,900 to £53,200. Examples include fractures of both heels or feet with a substantial restriction of mobility and/or severe and permanent pain.
Serious guidelines for foot compensation can be between £19,000 to £29,800. Examples are injuries less severe than in the severe bracket but leading to continuing pain from traumatic arthritis or the risk of it in future, prolonged treatment for the injury and the risk of fusion surgery.
Moderate guidelines for foot compensation can be between £10,450 to £19,000. Examples are displaced toe fractures leading to permanent deformity and symptoms.
Modest guidelines for foot compensation are upto £10,450. Examples include toe fractures, ruptured ligaments, puncture wounds etc.
Toe Injuries
The toe injury guidelines are also split into different categories:
- Amputation of all toes
- Amputation of big toe
- Severe toe injuries
- Serious toe injuries
- Moderate toe injuries
Amputation of all toes would range from £27,750 to £42,600.
Amputation of big toe would range be in the region of £23,800.
Severe toe injury guidelines range from £10,450 to £16,000. Examples would be severe crush injuries to toe, amputation of one or two toes that are not the big toe and injuries resulting in severe damage producing significant ongoing symptoms.
Serious toe injury guidelines range from £7,300 to £10,450. Examples can be serious injuries to big toe or multiple fractures of two or more toes.
Moderate toe injury guidelines range up to £7,300. Examples can include straightforward fractures, laceration injuries and soft tissue injuries.
