Whiplash from road traffic accidents and collisions generally fall into either the neck, shoulder or back injury bracket (or sometimes all three).
There is a very wide range of neck injuries and many are found in conjunction with other injuries to other parts of the body such as shoulders or back.
There are generally 3 different categories for neck injuries:
- Severe
- Moderate
- Minor
Severe Neck Injuries
A neck injury associated with incomplete paraplegia/permanent spastic quadiparesis/no movement in the neck and suffers from severe headaches could claim within the region of £112,750.
Neck injuries including serious fractures or disc damage in the spine which result in disabilities. Example can include permanent damage to the brachia plexus or substantial loss of movement in the neck and loss of function in one or more limbs. These guidelines are £50,000 to £99,500.
Injuries to the neck which cause fractures, dislocations, ruptured tendons, severe soft tissue damage that lead to chronic conditions and significant/permanent disability. Awards in this bracket will depend on ongoing treatment and length of time the symptoms persist. £34,575 to £42,550.
Moderate Neck Injuries
Neck injuries such as fractures or dislocations that cause immediate pain and symptoms and which may necessitate spinal fusion fall into this bracket. Other examples also include chronic conditions usually involving other parts of the body, serious soft tissue injuries and leaving impaired function and limitation of activities in future. £19,000 to £29,250.
Within this bracket are cases of soft tissue damage, wrenching type injury, severe disc lesion. £10,450 to £19,000.
Neck injuries which have accelerated and/or made worse a pre existing condition over a shorter period of time (usually less than 5 years). This bracket also includes moderate soft tissue damage where the recovery period lasts for a long time or where there remains an increased risk to further trauma. £6,000 to £10,450.
Minor Neck Injuries
Minor soft tissue injuries fall into this bracket. Duration of symptoms will be taken into account along with these other factors as example:
- Impact of the injuries on ability to work
- Severity of the injury
- Intensity of pain
- Additional Symptoms such as headaches
- Impact on everyday life
- Extent of treatment required
- The need to take medication
Where a full recovery happens within 1 to 2 years £3,300 to £6,000.
Where a full recovery takes place between 3 months and a year £1,860 to £3,300.
Where a full recovery is made within 3 months can range from a few hundred pounds to £1,860.
